These terms apply to consumers (B2C) with habitual residence in Germany who use the mobile app "Luminom". Deviating terms apply only if we expressly agree to them in writing.
Luminom is an app for digital memorial pages with features such as feed, gallery/album, grief journal, grief hub, access control/social circles and notifications.
The specific scope of services is defined by the app and the selected subscription. We reserve the right to changes or further development of app features, provided essential contractual obligations are not removed.
Registration is required for certain features. Users must provide truthful information during registration and keep their access data confidential.
There is no age restriction for using the app.
Users remain owners of their content. By uploading content, they grant us a non-exclusive, worldwide, sublicensable right to store, reproduce and make content publicly available for the purpose of providing app services, to the extent required for functionality.
Users warrant that they are entitled to grant these rights.
We may review and remove content if there are concrete indications of legal violations or breaches of these terms. We reserve the right to suspend user accounts in cases of serious or repeated violations.
Subscriptions are auto-renewing and are purchased through Apple In-App Purchase (App Store) and Google Play (Play Store). Billing, renewal and cancellation are handled via the Apple ID or Google account and the relevant store's subscription management.
Prices include any applicable VAT.
Luminom Plus: EUR 5.99/month or EUR 59.99/year
Luminom Premium: EUR 9.99/month or EUR 99.99/year
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period in the relevant subscription settings. Prices may change; Apple or Google will inform users according to store rules.
Subscription cancellations are made exclusively via subscription management in the App Store or Play Store. Refunds are at the discretion of the respective store operators and governed by their policies.
Consumers generally have a right of withdrawal. For digital content not supplied on a tangible medium, the right of withdrawal may expire if the consumer expressly agrees that contract performance begins before the withdrawal period ends and confirms loss of the right of withdrawal.
Note: Processing of withdrawal requests for in-app purchases is handled by Apple or Google. Please verify and complete statutory information obligations where required.
We strive for high app availability but cannot exclude maintenance windows, technical disruptions or limitations. Use requires a compatible device, internet connection and current app version.
Statutory warranty rights apply.
We are fully liable in cases of intent and gross negligence, injury to life, body or health, and under product liability law. In cases of slight negligence regarding essential contractual obligations, liability is limited to foreseeable, typical damage.
Information on the processing of personal data can be found in the separate app privacy policy.
We may change these terms where there is an objective reason (e.g. legal changes, feature adjustments). We inform users about material changes in the app or by email. If a user does not object within a reasonable period, the changes are deemed accepted. Additional details may be required.
German law applies. For consumers, statutory jurisdiction rules apply.
